We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

3. Account Registration and Responsibilities

6. User Content and Licenses

You retain ownership of any content you upload, submit, or create through the Service ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and process your content solely for the purpose of providing and improving the Service.

AI-generated outputs created through the Service are licensed to you for commercial and personal use in accordance with your subscription plan. You are responsible for ensuring that your use of generated content complies with applicable laws and does not infringe on third-party rights.

7. Acceptable Use Policy

You agree not to use the Service to:

• Violate any applicable local, national, or international law or regulation
• Generate content that is defamatory, obscene, hateful, or promotes violence
• Infringe upon the intellectual property rights of others
• Transmit malware, viruses, or any code of a destructive nature
• Attempt to gain unauthorized access to the Service or its related systems
• Use the Service to send unsolicited communications (spam)
• Impersonate any person or entity, or misrepresent your affiliation
• Interfere with or disrupt the integrity or performance of the Service

We reserve the right to investigate and take appropriate action against anyone who violates this provision, including removing content, suspending accounts, and reporting to law enforcement.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall MagicAds, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of (or inability to access or use) the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

9. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and course of dealing. AI-generated content may contain inaccuracies or errors. You acknowledge that you are solely responsible for reviewing and validating any content generated through the Service before use.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

You may terminate your account at any time by contacting us or using the account deletion feature in your settings. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which our company is registered, without regard to its conflict of law provisions.
